Agreement

By creating a Hearrd account or embedding the Hearrd widget, you agree to these Terms of Service ("Terms"). If you are agreeing on behalf of a company, you represent that you have authority to bind that company to these Terms.

These Terms form a binding agreement between you and Hearrd ("we", "us", "our"). Please read them carefully.

The service

Hearrd provides a voice feedback widget that businesses embed into their web products, along with a dashboard to view and manage the collected feedback. The service includes:

An embeddable JavaScript widget that captures voice feedback from end users

Automatic transcription of voice recordings

AI-powered categorisation and summarisation of feedback

A dashboard to view, filter, and manage feedback responses

Project management tools and API keys for integration

Accounts

You must provide accurate information when creating your account. You are responsible for maintaining the security of your account credentials. You must notify us immediately if you suspect unauthorised access to your account.

You may not share your account or API keys with third parties outside your organisation. Each API key is tied to a specific project and must only be used for that project.

Acceptable use

You may use Hearrd only for lawful purposes. You must not:

Use Hearrd to record users without their knowledge or consent

Collect voice feedback from minors without appropriate parental consent

Use the service to collect sensitive personal data such as financial information, health data, or government identifiers through voice prompts

Attempt to circumvent the widget"s consent notice

Reverse engineer, decompile, or copy any part of the Hearrd service

Use the service to transmit malware, spam, or harmful content

Resell or sublicense the service without our written consent

You are responsible for ensuring that your use of Hearrd complies with applicable laws in your jurisdiction, including data protection laws such as GDPR and CCPA.

User consent obligations

As a Hearrd customer, you are responsible for:

Informing your users that you use Hearrd to collect voice feedback

Including Hearrd in your own privacy policy

Ensuring that users are given appropriate notice before feedback is collected

Handling deletion requests from your users regarding their feedback

Hearrd"s built-in consent notice is provided as a convenience. You remain responsible for your own compliance obligations.

Subscription and billing

Hearrd offers a free tier and paid subscription plans.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.

We reserve the right to change our pricing with 30 days notice. Price changes will not affect existing subscriptions until the next renewal period.

If your payment fails, we will attempt to contact you. If payment remains outstanding after 14 days, your account may be downgraded to the Free plan.

Data and ownership

You retain ownership of all feedback data collected through your Hearrd projects. We process this data on your behalf as a data processor.

We retain the right to use anonymised, aggregated data to improve the service, such as improving transcription accuracy or feedback categorisation. This data cannot be used to identify individual users or customers.

Upon account deletion, we will delete all your project data, feedback responses, and audio recordings within 30 days.

Service availability

We aim to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, which we will try to schedule during low-traffic periods with advance notice where possible.

We are not liable for any losses resulting from service downtime, data loss, or delays in processing.

Limitation of liability

To the maximum extent permitted by law, Hearrd"s total liability for any claim arising from these Terms or the service is limited to the amount you paid us in the 3 months preceding the claim.

We are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits, loss of data, or loss of business, even if we have been advised of the possibility of such damages.

Termination

You may close your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.

Upon termination, your right to use the service ends immediately. We will delete your data in accordance with our data retention policy.

Changes to these Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before any material changes take effect. Your continued use of the service after that date constitutes acceptance of the new Terms.
